Smoking Ban in the Shinjuku Street An ordinance to prohibit smoking in the street of Shinjuku City has been, in effect, since August 2005. We often see smoking inspectors on the busy street in Shinjuku. However, they never observe in other wide areas of the city. There is no actual penalty for a violator. In 2010, we still see smokers in the street, discarding the cigarette butts and tobacco package. This local ordinance appears to be effective when the inspectors are walking around the main street of Shinjuku district in Tokyo. (L) In the designated smoking space near JR Sinjuku station, an information board was placed in front of a cigarette disposal. It says that, please cooperate with our separation policy of smokers from nonsmokers, and asked smokers to practice a good manner in streets. A smoking area in front of Shinjuku Station West Exit Get off sidewalk smokers, and go inside to smoke. 健康増進と矛盾した医師会主催の新年祝賀会 新宿区路上喫煙禁止条例 空き缶等の散乱および路上喫煙による被害の防止に関する東京都新宿区条例が2005年8月より施行された。 しかし、罰金を徴収していないため、あたり構わず喫煙する人はあまり減っていない。当初、新宿区役所発行の 広報誌は路上喫煙禁止の理由について、「迷惑であるから」と述べていたが、最近では他人にタバコの 煙を吸わせないようにと受動喫煙防止と健康上の理由を掲げている。努力義務であり、違反者には最高2万円を 科すが、名目だけで実施は徴収していない。繁華街では監視指導員の姿を目にするが、直ぐ目の前で吸っていない 限り注意しない。 東京都新宿区路上禁煙条例が施行された2005年8月に施行されから１ヶ月以上経過したときに新宿区役所前、 靖国通りで撮影した映像である。週末ともなれば、さらに多くのタバコの吸い殻が道路に散乱する。 繁華街や住宅地では、タバコをくわえたまま歩行する人はあとを絶たない。新宿区内にある私の家の前の 歩道には毎日、4〜5本のタバコの吸い殻が捨てられているが、その数は最近減少している。 札幌市で違反者に科料1000円を課したところ歩きタバコは90％減少したとの報告がある。このように札幌市や 千代田区で実行しているように実際に罰金を徴収しなければ、「条例は無視し破ってもよいもの」との 考えを定着させる恐れがある。 筆者のごく近くの横断歩道近くに「路上喫煙禁止」のマークが貼り付けられている。この標識がどの程度の 効果があるのか、毎日落とされているタバコの吸い殻の数を見てみれば分かる。モラルの低い、中毒となった 喫煙常習者は平気でタバコの吸い殻や箱を捨てたりしている。 上記標識を歩道上に貼り付けてからは道の真ん中に吸い殻を捨てるのではなく、歩道脇や植え込みに 放り投げているケースが多い。気持ちの上では多少心苦しいところがあるのかも知れない。 しかし、 そもそも自己管理の出来ない喫煙者にモラルを求めているのが間違いなのだ。罰金を徴収しない条例は 実効性に欠けるのである。 　新宿区路上喫煙禁止条例 医学博士　宮本順伯 The article was written in September 2005, and last revised in September 2021, by Junhaku Miyamoto, M.D., PhD.
